Istanbul Chief Public Prosecutor’s Office has completed the 195-page supplementary indictment prepared against 29 people, including Ekrem İmamoğlu, Fatih Keleş, Ali Sukas and Ümit Polat, as part of the Ağaç ve Peyzaj AŞ investigation. The file was merged with the main İBB case being heard by the Istanbul 33rd High Criminal Court, in which 414 defendants are on trial.
Following the merger, the number of defendants in the main case rose to 435, and 12 actions numbered from 144 to 155 were added to the file. While the supplementary indictment does not additionally accuse İmamoğlu and Keleş of “establishing and managing an organization,” it seeks to hold them responsible under TCK 220/5 for the offenses involved in the 12 actions.
Why it matters
The merger of the file with the main case means that the allegations in the Ağaç ve Peyzaj AŞ investigation will be addressed as part of the İBB main case as a whole, rather than in a separate trial. As a result, the scope of the individuals and actions to be examined by the court will expand, while the defenses of the existing defendants will need to be assessed together with the 12 newly added actions. The fact that İmamoğlu and Keleş have not been additionally accused of establishing and managing an organization shows that the legal framework concerning them differs from the other charges; however, the request to hold them responsible under TCK 220/5 maintains their position in the file. The key issue going forward will be how the court assesses the connection between the added actions and the main case, and how the merger shapes the scope of the proceedings.
