Following Yenilik Partisi’s application concerning name similarity, the Office of the Chief Public Prosecutor at the Court of Cassation referred the request to the Constitutional Court after the deadline given to YENİ Parti for a name change expired on September 18. The AYM General Assembly will consider tomorrow the allegation that YENİ Parti’s name violates the Political Parties Law.
The AYM is expected to request YENİ Parti’s defense. A decision will be made after the Chief Public Prosecutor’s submission, Yenilik Partisi’s opinion and YENİ Parti’s defense have been reviewed; if a violation is established, the party’s name may be deemed invalid and it may be removed from the register of political parties. YENİ Parti had decided not to change its name until a decision was issued.
Why it matters
The case coming before the AYM carries the dispute over the similarity of the names of the two parties into a binding review concerning the registration and naming rules for political parties. Therefore, the decision will not be limited only to the name used by YENİ Parti; it will also determine whether the party’s registration in the register of political parties will be maintained. The review will conclude after the Chief Public Prosecutor’s application, Yenilik Partisi’s opinion and YENİ Parti’s defense are assessed together; this shows that the current stage does not yet constitute a final sanction. The key question that remains is whether the AYM will find the use of the name to violate the Political Parties Law and whether, in the event of such a finding, this will result in removal from the register.
