The verdict was announced at the second hearing in the case of 16-year-old Atlas Çağlayan, who was killed in a knife attack in Güngören on January 14. The Bakırköy 2nd Juvenile High Criminal Court sentenced detained defendant E.Ç., who was 14 at the time of the crime, to 14 years and 9 months in prison for “intentional killing of a child.” The defendant was also sentenced to 3 years and 9 months in prison for “armed threat” against four people, 4 months and 15 days in prison and a judicial fine equivalent to 50 days for violating the Firearms Law No. 6136. The court took the defendant’s age into account when determining the sentence for the threat offense. E.Ç.’s total prison sentence amounted to 18 years, 10 months and 15 days. At the first hearing, the prosecutor had presented the opinion on the merits.

Why it matters

The scope of the verdict shows that the case addressed not only the attack on the right to life but also the alleged threats against four people and the alleged violation of firearms legislation as separate issues. The fact that the defendant was 14 at the time of the incident places the impact of age on sentencing for child defendants at the center of the case; the court took this into account at least when determining the sentence for the threat offense. In this way, the ruling makes visible the balance between the expectation of justice among the victim’s relatives and the limits of the penalties to be imposed on child defendants. However, the text contains no information about the legal process that will follow the ruling; therefore, whether the verdict will become final and the conditions of its execution remain unclear.
